After receiving the SSDI Review, the SSA will decide whether to approve, defer, or remand. It then sends a memo to the MDH Unit, indicating whether the data-related agreement is approved, deferred, or remanded. If the agreement is approved, the MDH unit may proceed with execution.
If an applicant is denied, the SSA sends a second warning. The applicant who was denied has sixty-five business days from the date to request a hearing in front of an Administrative Law Judge (ALJ). A Data-Related Agreement (DRA) is a legal document which requires the approval of the SDI Team before execution. These agreements must submitted via CognitoForms. The SDI Team has 30 day to review the Data-Related Agreement and may ask for additional information like security controls and an SOC 2 Type II audit. They may also ask questions like data migration questions.
Once a Data-Related Agreement (DRA) is submitted, the SDI Team reviews the documents and will recommend contracts. The Agreement will be subject to the same security and privacy policies as other forms of documentation submitted through Cognito Forms.
